Hemp-Based vs THC-Based Products: What's the Difference?

Hemp and marijuana are the same plant species — the difference is how much THC they contain, how they're regulated, and how they make you feel.

Walk into any smoke shop or grocery store and you'll see "hemp" gummies, CBD oils, and drinks. Walk into a licensed dispensary like Union Cannabis Club and you'll find THC flower, vapes, and edibles. Both come from Cannabis sativa — so what actually separates them?

The legal line: 0.3% THC.

Under U.S. federal law, "hemp" is cannabis containing no more than 0.3% delta-9 THC by dry weight. Anything above that is classified as marijuana. Hemp-derived products are typically made for CBD and other non-intoxicating cannabinoids, while THC-based products are grown specifically for their THC content and sold only through state-licensed dispensaries.

Hemp-based products.

  • Usually focused on CBD, CBG, or CBN, with little or no THC.
  • Generally non-intoxicating — most people feel calm or relaxed, not "high."
  • Popular as tinctures, topicals, capsules, and wellness products.
  • Quality varies widely outside the licensed market, so look for a lab certificate of analysis (COA).

THC-based products.

  • Contain meaningful amounts of THC, the cannabinoid responsible for the classic high.
  • Sold in California only to adults 21+ through licensed dispensaries.
  • Every product is state-tracked and lab-tested for potency and contaminants before it reaches the shelf.
  • Available as flower, pre-rolls, vape cartridges, edibles, concentrates, beverages, and more.

What about "hemp-derived THC"?

Some products use hemp-derived cannabinoids like delta-8 THC or concentrated delta-9 to create intoxicating effects while staying under the dry-weight limit. Rules for these products are changing at both the state and federal level, and they don't go through the same testing as dispensary products. If you want a THC experience, buying from a licensed shop is the safer, more predictable choice.

Which one is right for you?

  • Want relief without feeling high? Start with CBD-forward or hemp-derived products.
  • Want a balanced effect? Try a 1:1 CBD:THC product — CBD can soften THC's intensity.
  • Want the full cannabis experience? Choose THC flower, vapes, or edibles, and start low and go slow.
